1. Acceptance of Terms
By creating an account or using the UptimeJack service (the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Service. These Terms constitute a legally binding agreement between you ("User") and DEGIKA Systems Sp. z o.o. ("we", "us", "our").
2. Description of Service
UptimeJack is an automated uptime monitoring platform that performs scheduled checks against external hosts and endpoints specified by the User. The Service includes, but is not limited to:
- HTTP/HTTPS response checks (status code, response time)
- Keyword presence/absence checks in page content
- ICMP ping (reachability) checks
- TCP port availability checks
- Email and Slack alert notifications upon detected failures
- Public status pages for sharing uptime data
- Prometheus-compatible metrics export endpoint
3. User Obligations
You agree to use the Service only for lawful purposes and in accordance with these Terms. Specifically, you must not:
- Configure monitors against hosts or services you do not own or are not authorised to monitor
- Use the Service to perform, facilitate or disguise denial-of-service attacks, port scans or any other form of hostile network activity
- Attempt to circumvent rate limits, authentication mechanisms or any other technical controls
- Resell or sublicense access to the Service without prior written consent
- Provide false registration information
We reserve the right to suspend or terminate accounts found to be in breach of these obligations, without prior notice.
4. Billing & Subscriptions
A free tier is available with limited capacity (up to 10 monitors, 5-minute check interval, email alerts). Paid plans are billed monthly or annually in advance. All prices are in US Dollars (USD) and exclusive of VAT/tax where applicable.
Payments are processed securely by Stripe. We do not store your payment card details. By providing payment information you authorise us to charge the amount stated at the time of subscription.
Subscriptions renew automatically. You may cancel at any time; cancellation takes effect at the end of the current billing period. We do not issue refunds for unused portions of a billing period, except as required by applicable law.
5. Data & Privacy
We collect and process personal data (name, email address, billing information, IP address, usage logs) strictly to provide and improve the Service. We do not sell personal data to third parties. Data is stored on servers located within the European Union. Full details are available in our Privacy Policy (available upon request at questions@degika.systems).
6. Service Availability & SLA
We strive to maintain high availability of the Service, but we make no guarantee of uninterrupted, error-free operation. We may perform scheduled or emergency maintenance at any time. We will endeavour to notify users in advance of planned maintenance where possible.
7. Disclaimer of Liability — What We Are Not Responsible For
UptimeJack is a monitoring and notification tool only. We detect and report the status of your services; we do not control, operate, or maintain those services in any way.
We are not responsible or liable for:
- Any downtime, data loss, or business interruption experienced by you or your customers, regardless of whether UptimeJack detected or failed to detect the issue
- Missed or delayed alerts caused by email delivery failures, Slack API outages, network issues, or any third-party service interruption
- False positive or false negative check results — monitoring results are best-effort and should not be the sole basis for critical infrastructure decisions
- Actions taken or not taken by you or your team in response to (or in the absence of) alerts from the Service
- Any indirect, incidental, special, consequential, or punitive damages arising from use of or inability to use the Service, even if we have been advised of the possibility of such damages
- Security incidents on your monitored infrastructure — UptimeJack monitors availability only and does not perform security scanning
- Third-party integrations (Stripe, Slack, Prometheus, etc.) — we are not responsible for the availability, accuracy or behaviour of external services
- Data loss due to account deletion — you are responsible for exporting any data you wish to retain before closing your account
To the maximum extent permitted by applicable law, our total aggregate liability to you for any claims arising out of or related to the Service shall not exceed the amount you paid us in the 3 months preceding the event giving rise to the claim. If you are on the free plan, our liability is limited to EUR 10.
8. Intellectual Property
The UptimeJack platform, including its source code, design, trademarks and documentation, is the intellectual property of DEGIKA Systems Sp. z o.o. You are granted a limited, non-exclusive, non-transferable licence to use the Service for its intended purpose. Nothing in these Terms transfers any intellectual property rights to you.
9. Modifications to the Service and Terms
We reserve the right to modify, suspend or discontinue any part of the Service at any time. We may update these Terms from time to time; continued use of the Service after changes are posted constitutes your acceptance of the updated Terms. Material changes will be communicated by email or in-app notification.
10. Governing Law & Dispute Resolution
These Terms are governed by and construed in accordance with the laws of the Republic of Poland, without regard to conflict-of-law principles. Any disputes arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of Częstochowa, Poland. EU consumers retain the right to bring proceedings before the courts of their country of domicile.
